Lomidze
Davit Lomidze, a 53-year-old man, was arrested on December 1, 2024, during a protest in front of the Parliament. Temur Zasokhashvili was also arrested with him. Initially, they were detained administratively, but after 48 hours, when the administrative detention period expired, they were charged with criminal offenses.
According to the Prosecutor's Office, Davit Lomidze and Temur Zasokhashvili, on the night of December 1, in front of the Parliament, on Chichinadze Street, threw so-called "Molotov cocktails" at employees of the Special Assignments Department and damaged a water cannon vehicle belonging to the Ministry of Internal Affairs. They were charged under Article 353 prima of the Criminal Code of Georgia, which refers to assaulting a police officer and carries a sentence of 4 to 7 years in prison.
During the arrest, police physically assaulted Davit Lomidze. According to his lawyer, after the arrest, in a minibus where he was with other detainees, his hands were tied behind his back and he was beaten. This worsened his health condition, as he had undergone spinal surgery in the past.
The Tbilisi City Court remanded Davit Lomidze in custody as a preventive measure. Judge Nana Shamatava stated that the decision was made taking into account the defendant's personality, past, the nature of the charge, and the type of crime. The defense requested his release on bail, but the court rejected this motion.
Davit Lomidze did not appear at the court hearings due to his deteriorating health. According to his lawyer, he has difficulty moving and has been transferred to a prison medical facility. At the court hearing, a police officer was questioned who stated that he had obtained a confession from Lomidze in the detention center. However, Lomidze claims that the statement is not true and that he was pressured.
At the court hearing, Davit Lomidze's son stated that his father's health condition is severe and that he is not receiving adequate medical attention in prison.
«I met him on January 16, 2025, when he was still able to move, but he complained of pain in his leg and spine. His condition worsened, and he was unable to go out or meet with me. We believe that the pain in his operated areas was provoked by the violence inflicted on him during his arrest»
This case highlights several issues that indicate non-compliance with the law:
- Physical violence by the police during the arrest.
- The court's decision to keep a person with a severe health condition in custody.
- Possible violations during the process of obtaining a confession
